My debt to Capitec Bank was prescribed in February 2014, As I find out from Capitec it was bought from them by DMC. Recently I have been dubbed to agreeing to pay prescribed debt, I have not made payments to this account from May 2011 until May 2014. From now onwards I do not intend to sign anything or pay anything. If you issue summons, do so at my current address and I will defend the summons based on prescription and ask for legal costs against them. Listing prescribed debt on a credit bureau is specifically prohibited by the regulations to the National Credit Act and any attempt to list me will result in a defamation of character claim against you, of which my name is still listed under Capitec Bank on Experian and Transunion Credit Bureau.
If you want to prove that the debt was not prescribed please send me in writing to my current address, I also want proof of debt, the original contract, proof of date of Default, and handover amount and a breakdown of all the costs. I demand that my file be closed and my name cleared from all credit Bureaus.
