Midland called me 4-5 times a day for months, for what much later turned out to be four separate accounts, none of which were mine. There were months of hang up and robo-calls. No message ever left on answering machine, and if I picked up, there was just dead air. The caller ID said "1 Unavailable". It was impossible to call back and impossible to learn who was even making these harassing calls.
Midland's phone company is AT&T California, and should be equally liable for this constant harassment, as they knew or should have known that MIdland was using this caller ID to cloak its illegal activities. After months and months of this, when I was being treated for cancer and was very ill, and really needed my rest during the day, I picked up and there was actually a person there. He started harassing me about a debt that was not mine, owed by a person who was not me, and repeatedly refused even to identify the business.
Finally, he said it was "MCM" but would not provide more information. I learned only through the internet that it was Midland Credit Management. I got a customer service phone number which was continually busy, but kept dialing and dialing and finally got a person, who promised to remove my number but never did. This happened over and over. I have an attorney now but even after the attorney told them to stop.
The calls still kept coming sporadically for quite a while. Midland has offered $750 plus attorney fees to settle, but they have included unacceptable provisions in their proposed settlement agreement, including excusing themselves from compliance with various laws and a gag order. Apparently, the gag order is important to them, so I am taking this opportunity, while they decide whether to delete the objectionable provisions, to blab all over the internet about what they did to me and are clearly doing to many, many others. I am also working on reporting them to regulatory authorities. They are nationwide, so I am going to work my way through every single state and blab to the regulators what Midland is doing. Maybe somebody will take action against them.
