The neighbor's tree roots damaged the common shared block wall between our homes. State Farm in Dec 2011 (neighbor's insurance company) appraised the damage at $4,500 and issued us a check for 50% of the repairs as the wall is technically only 1/2 ours and 1/2 their insurer. They told us to get the wall repaired and collect the balance from the neighbor (their insurer). The neighbor, Mr., refused to give us his phone number so we could discuss and had delayed any repairs until now, June 2012. We hired a contractor that matched the appraised repair cost of his insurance company and after a deposit from us of $1,700, started the repairs. The neighbor, Mr., refuses to allow the hired contractor to repair the block wall as he has stopped him twice during the repairs, threatening to sue him if he continues working.
We have paid out now a nonrefundable deposit of $1,700.00 and cannot get the block wall repaired as Mr. Will not allow any contractor to work. He states that his insurance company over appraised the repairs and the real repairs would be less than $300. Because the block wall is not visible to Mr., he is not interested in any repairs. The block wall is very visible to our home and backyard and needs to be repaired. State Farm told us they can do nothing. Mr. Refuses to allow the repairs and we do not know how to fix 1/2 of the block wall. For the record, you couldn't put up a cotton string between the property for less than $300, let alone a 60ft concrete block wall. I hate State Farm so much that I have cancelled all our rental properties that up to now have insured us. You should also do the same. Cancel State Farm.
