The owner of the property we rented, Michelle van den Berg, took her contract over from Compact Properties to Huurkor in 2009.in 2011 Huurkor requested us to pay the deposit as it has never been done according to them. We paid the deposit to Compact Properties in 2005 when we started renting the property. Huurkor did not ensure that the deposit was taken over with the contract and waited two years until they tried to recover the deposit from Compact, who by then was closed down due to bankruptcy. Huurkor lost our deposit in the sense that they were negligent in ensuring that the deposit was carried over. Now we have trouble getting the deposit of R4400 back from them. The owner, Michelle van den Berg, also does not want to take responsibility for the lost deposit, even if the Rental Housing Act stipulates that she still remains accountable for the deposit. This issue has been dragging since 2009. We did supply proof of payment, although archive bank statements does not show the recipient.
